Sort of a victory for Gail Gagne - no jail time

A former Cretin-Derham Hall teacher accused of having sex with a former high school football star agreed Monday to have her case decided by a Hennepin County district judge without a jury.
The judge will make his decision based on stipulated facts submitted to him, with the understanding that Gail Gagne will not receive jail time if convicted.

Gagne is the daughter of former professional wrestler Greg Gagne, who accompanied her to court on Monday, and the granddaughter of former wrestler Vern Gagne.

Gagne, formerly of Bloomington, was hired by the St. Paul school in November 2007 as an assistant basketball coach and worked as a substitute teacher from January through September 2008. She was then hired as a full-time teacher. In the summer of 2008, she was a weight-room instructor and supervised the teenager, who was 16 at the time. She was 25.

During the summer of 2008, Gagne took the victim out for meals, gave him rides home from the school and engaged in sexual contact with him, according to the complaint. Gagne also took the victim to a hotel near the Mall of America in the summer of 2008 and engaged in sexual acts there, the complaint states.

She allegedly engaged in sexual conduct with the teenager from July 1 to Sept. 1, 2008, which accounted for the first felony charge that was dropped. She allegedly had sex with him again at a Bloomington hotel Sept. 13-14, 2008, which led to the second charge that was reduced from a felony to a gross misdemeanor.
